My mother had her land and buildings in trust. Naming her trustee of the trust. When she died;myself and three siblings are named the beneficiaries. My eldest brother we nominated the trustee of the trust after her passing.
In the trust the "Duration" paragraph states termination is (a)the death of the trustee(at signing was my mother) or (B)expiration of 20 years(2016). Is the trust still valid?

I am being told the trust ended the day my mother died. Why then did we need to nominate a trustee?

Also in the trust documentation is paragraph "termination" which states the trust shall be terminated by trustees's own initiative or upon written request of a majority of beneficial interest, and the termination recorded at the Registry of Deed's.......

My siblings and I do not agree on a selling price, does that statement of Termination mean that the three of them can terminate by majority against me and sell the house at their price?

If the "Duration" paragraph is true, what value is the Termination paragraph?
I've been sent papers to sign which I'm told would make the beneficiaries "Tenants in Common". Does that result in:
1.Terminate the trust.
2.Make it possible that my siblings can sell at whatever price and I would have to accept because of them being the majority.

They've also threatened to "Petition the Court" for the sale of the house. How does that work?

As I recall the First Amendment states: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

Hmmm...a double standard for those who pull the race card to gain public office?

I've seen individuals in front of grocery stores asking for signatures to get an initiative on a future ballot. The individuals have said they make great money, and I'd like to know how to start my own petition business. Please share the process of making contacts, obtaining the initiatives, and most importantly the flow of payment from the initiative promoter on down. Thanks for your input...

We need a way to suggest national law. A ballot initiative would do well, but this is a Republic, and I don't know enough about it to see the way to do it. And we need to be able to bring ballot questions to the ballot on a regular basis. Every two years.. and yes that would be costly, but if enough people were present on the ballot initiative, that extra cost would be acceptable.

Is there a way to petition congress and force a law to be made?
Voting does not add specific law. We need a way to suggest, and vote on laws that would affect Congress and the People. Voting, by the way, doesn't deal with either idea.

To be specific, when will you get your act together and organize a petition drive to repeal your state's flagrantly unconstitutional gun laws? After all, Proposition 8 passed.
I was out there in 1982, when the "handgun freeze initiative" (Prop, 15) was on the ballot. All the pundits were predicting that it would pass by a 2-1 margin, but it got defeated by that very margin, or close enough. I'll tell you what, when the TV newscasters had to read those results, it looked like somebody had just pooped on their sushi platters.
Is it really that bad out there? I haven't been there since '82.

Can regular people try and propose new state laws ( through initiatives-- petitions?)? Is it possible that a citizen- developed proposition can make it on the ballot?

it will repay Acorn for helping in the Major Theft of the election?
Obama Giving ACORN $5.2 Billion in Stimulus Funds
A rising chorus of GOP leaders are protesting that the blockbuster Democratic stimulus package would provide up to a whopping $5.2 billion for ACORN, the left-leaning nonprofit group under federal investigation for massive voter fraud. What if Barack Obama’s most important radical connection has been hiding in plain sight all along? Obama has had an intimate and long-term association with the Association of Community Organizations for Reform Now (Acorn), the largest radical group in America. If I told you Obama had close ties with MoveOn.org or Code Pink, you’d know what I was talking about. Acorn is at least as radical as these better-known groups, arguably more so. Yet because Acorn works locally, in carefully selected urban areas, its national profile is lower. Acorn likes it that way. And so, I’d wager, does Barack Obama.
According to the law, registered voters must sign, print their name and list their address on petitions calling for a ballot initiative. It doesn't take a handwriting expert to see that many of these were filled out by the same person. (Also, see pages 30-42 and take note of the signatures — a bit odd to sign your last name first, isn't it.)

ACORN Is A Bad Seed
Something’s rotten in the state of New Mexico, and Ohio, and Michigan, and Pennsylvania, and Florida, and…

ACORN says it is a community group, but it is really a multi-million-dollar, multinational conglomerate. Its political agenda is driven by a relative handful of anti-corporate activists. ACORN spends millions of dollars to promote economic policies (like raising the minimum wage), but has admitted that it doesn't always want to abide by them. ACORN advocates for workers' rights and runs two unions, but has in the past fought its own employees' efforts to form a union.

ACORN's history makes for pretty interesting reading. The Clinton Administration found that ACORN was misspending government grants designed to help counsel the poor. Although it seeks minimum wage increases in cities and states across the country -- ACORN sued the state of California to get out of paying its own employees the state minimum wage.

ACORN's practices have corrupted our political process as well. It has engaged in questionable election activities for years—stretching back even to the organization's founding years in Arkansas. In recent years, as its political power has increased, so have instances of fraud.

How about, America? As you may recall from a history class, the Progressives argued that direct democracy would rescue Americans from the tyrannies of special interests (or pluralism) and elitism (19th century plutocrats). In California, especially since Proposition 13 (1978), we have developed quite a habit of proposing laws by petition (initiatives) and then voting on them in the next election. What do you think of this way of making decisions? Consider a recent proposition such as Proposition 8 (marriage).

Do you think the people should be deciding these issues? Or would it be better if the state government (legislators in the State Assembly and the State Senate plus the governor) decide.

Suspects’ lawyer admits drafting order

MANILA, Philippines – (UPDATE) The lawyer for two of the three suspects in a controversial drug case has admitted that he drafted the release order and sent it to the Department of Justice.

Felisberto Verano confirmed a statement by justice undersecretary Ricardo Blancaflor who told the House of Representatives investigating the issue that the lawyer sent the document to his office for delivery to Justice Secretary Raul Gonzalez.

In an interview after he filed a petition for habeas corpus for Joseph Tecson and Richard Brodett Tuesday, Verano said since it was Christmas time, he was “doing the boys a favor,” referring to his clients.

Verano admitted that what he did was not normal, but did not see anything wrong, saying that if Gonzalez did not sign it, then there was nothing he could do about it.

He said his conversation with Gonzalez who promised that he would study the resolution issued by Chief State Prosecutor Jovencito Zuño gave him hope that the three suspects would be released.

Verano said what he did was “not influencing but simply facilitating” for the immediate release of Brodett, Joseph and Tecson.

"The letter was going to be signed by the Secretary of Justice. I just facilitated it," Verano said.

Asked how he got hold of the DOJ letterhead, Verano said "I got hold of it sometime in the past. I go in and out of the DOJ."

"I was doing the boys a favor," Verano said, pointing out that it was almost Christmas and since the case had been dismissed, he took the initiative to make the draft.

I'm organizing a petition drive to get President elect Barack Obama to introduce the following legislation, HR 8181 dubbed 'The Creeper Bill'.
It shall legally require all men labeled 'creepy' by women to wear distinguishing arm bands and to introduce themselves as 'creepy' preceding any business transactions. They shall also be assigned separate rest rooms and drinking fountains in public (god knows where they've been) as well as attend different schools (to relieve the duress felt by the female student body). To cover the costs of implementing these measures 'creepy' guys shall also attend 're-education camps' where they'll work in agriculture and manufacturing to the benefit of their respective communities while learning, through 'scared straight' initiatives, to not look at a woman twice or even dream they can express their sexuality as non-creepy men do.
I'm just testing the water to see how many ppl I can count on to sign my petition.

Socialism always destroys personal freedoms by trying to plan for other lives through a central government system that watches out for you. (This is why President Reagan once quipped that the worst words you could ever hear were these: “I’m from the government and I’m here to help you!”) Capitalism allows you to plan for yourself. It allows for creativity and enterprise. Furthermore, it encourages people to provide for others in order to express their creativity through goods and services. Greed is, in reality, inimical to capitalism. Greed drives the welfare state more than it does capitalism since greedy people want unearned rewards to be given to them by a benevolent government that levels the playing field. Such a system directly causes people to petition governments to solve their personal problems, and the bigger the government’s role becomes the worse the nightmare.

The problem with liberal economic state-based solutions is that they undermine this cycle of personal success and initiative. Capitalism allows even “the wretched of the earth” to succeed. Envy and greed create wars and revolutions. Witness the great twentieth century bloodbaths, most of which revolved around economic thoughts and the role of government in engineering material possession and seeking to level the playing field economically.

Many young Christians are being sold a bill of goods about the evils of capitalism by evangelical writers such as Ron Sider, Tony Campolo and Jim Wallis. The intentions of these men are generally good. They desire equality, which is good. They also hate injustice and racism. This is also very good. But the equality of means and income is not the basis of real freedom. Even lifting everyone out of poverty is not possible since poverty is rooted in much more than access to more money.

"life, liberty, and the PURSUIT of happiness" (emphasis added)
"provide for the common defence, PROMOTE the general welfare..." (emphasis added)
"to secure the blessings of LIBERTY, to ourselves and our posterity" (emphasis added)

Are we now a country were liberty, individualism, self-reliance, and initiative are considered greedy and bad, and now we have a society who expects that the government will always catch them when they fail and take away risks from our decisions? Are you an employer who provides a lot of jobs, go ahead take risks, and make bad decisions, the government will prop you up!

Are you a bank that made risky loans? Don't worry, the government will bail you out!

Are you a homeowner who took out an stupid mortage you couldn't afford? Don't worry, the government will bail you out!

Don't have a job? Don't worry, no need to retrain, move, or work on your skills, the government will dole out money to create one for you!
Are we a country that now believes the government needs to PROVIDE the general welfare, not just PROMOTE it?
Are we a country where everyone expects the government to provide them happiness, not just the opportunity to pursue it?

Should we petition to become part of Britain again since so many people seem to admire their cradle to the grave welfare system, health care, gun laws, etc?

Funny how it's always about WAR with McCain...

Shocking Choice by John McCain

WASHINGTON-- Senator John McCain just announced his choice for running mate: Governor Sarah Palin of Alaska. To follow is a statement by Rodger Schlickeisen, president of Defenders of Wildlife Action Fund.

“Senator McCain’s choice for a running mate is beyond belief. By choosing Sarah Palin, McCain has clearly made a decision to continue the Bush legacy of destructive environmental policies.

“Sarah Palin, whose husband works for BP (formerly British Petroleum), has repeatedly put special interests first when it comes to the environment. In her scant two years as governor, she has lobbied aggressively to open up the Arctic National Wildlife Refuge to drilling, pushed for more drilling off of Alaska’s coasts, and put special interests above science. Ms. Palin has made it clear through her actions that she is unwilling to do even as much as the Bush administration to address the impacts of global warming. Her most recent effort has been to sue the U.S. Fish and Wildlife Service to remove the polar bear from the endangered species list, putting Big Oil before sound science. As unbelievable as this may sound, this actually puts her to the right of the Bush administration.

“This is Senator McCain’s first significant choice in building his executive team and it’s a bad one. It has to raise serious doubts in the minds of voters about John McCain’s commitment to conservation, to addressing the impacts of global warming and to ensuring our country ends its dependency on oil.”

This is what she considers "environmental policy":

I have some sad news. Unfortunately, Alaska voters defeated a ballot initiative yesterday that would have ended the state’s brutal aerial hunting program.

Thousands of Defenders of Wildlife Action Fund supporters gave invaluable support to this important campaign, but in the end, deep-pocketed special interests carried the day.

This morning, I spoke with Nick Jans, co-chair of Alaskans for Wildlife, our grassroots partners in The Last Frontier who spearheaded the state ballot initiative to end Alaska’s brutal aerial hunting program. He wanted me to pass on this message to you:

“I want to thank Defenders of Wildlife Action Fund supporters for their help in this hard-fought campaign.

"We faced an approximately $750,000 campaign from our opponents -- including Safari Club International and a $400,000 state-funded campaign approved by Governor Sarah Palin and the Alaska legislature. They used deceptive propaganda and the authority of the Alaska government to defeat the ballot initiative.

"But thanks to the generous support of Defenders of Wildlife Action Fund activists and donors, we were able to reach thousands of voters. Yesterday, over 75,000 Alaskans voted to end this barbaric practice.

“Despite this loss, we’re not giving up -- Alaskans for Wildlife will continue to hold the state Board of Game’s feet to the fire and redouble our efforts to end this brutal program.”

Defenders of Wildlife Action Fund will continue to partner with groups like Alaskans for Wildlife and our sister organization Defenders of Wildlife to end Alaska’s slaughter from the skies.

As we prepare for another bloody season of aerial hunting in Alaska, we are redoubling our efforts to pass the Protect America’s Wildlife (PAW) Act in Washington, DC to bring an end to Alaska’s aerial hunting program -- and prevent programs like it from spreading to places like the Greater Yellowstone region.

This bill already has strong bipartisan support in the House of Representatives -- now we must ensure that this important bill gets passed.

Please take a moment to write to your Representative in Washington, DC and urge him or her to support this important wildlife-saving legislation today.

Once again, thank you for your support in this important campaign. Together, we’ll continue to fight for sensible wildlife management -- and end the senseless slaughter of wolves by airborne hunters.

Sincerely,

Rodger Schlickeisen
President
Defenders of Wildlife

Shooting wolves from airplanes and targeting the last unspoiled region of America for a stop-gap "quick fix" of oil drilling that will do NOTHING to help America's fuel problems.

Please help the Wildlife in this country, animal lovers. Please go to Defenders.org and sign their petition and please vote NO to McCain/Palin in '08. I don't care if you vote Blue Blob from Outer Space, just don't let these national resource ravagers run our country.

Thank you.

EDIT TO JHILL: How about preserving the Moose population by restricting HUMAN HUNTERS that are after trophies and not substenance? Wolves eat moose. Humans mount them. Sure, it's a much easier fix to blow away a bunch of wolves than it is to stop taking in all the revenue from the hunting licenses. And your reference to 'baby' is sad. What's cuter, a baby moose or a baby wolf? EVERYTHING kills to eat. Even vegetarians.
EDIT TO GEN PATTON: Way to hide behind no email. I welcome email. Even when I totally disagree with someone, like you, I let them state their opinion. Can't you read? I DESPISE PETA. There. Got that? PETA undermines everything I believe in with their radicalism and lack of science. I love science. I am a realist. SCIENCE says that we need predators. Like we need air. Like we need ozone. Like we have 1 BILLION people at risk if the coasts flood due to climate change. SCIENCE says Hurricane Gustav is gonna whack New Orleans again. What do you say to SCIENCE???
Andrew: What happened to the F-bomb I just raved to you about? Damn censors... LOL the other day one of my YA friends said their dog got into some go ok and YA censored it as "ethnic slang."

Jim works for a political action committee. He is currently working on a team project to collect signatures for a ballot initiative. Each of the members of his team has to go out into the community and ask as many people as possible to sign a petition. At the end of the project, the team will be paid $1 for each signature collected.

While out in the community, Jim can choose to work hard or to shirk. If he shirks, he will collect 25 signatures. If he works hard, he can collect 50 signatures. Jim prefers shirking to working hard: specifically, Jim estimates his cost (in lost utility) of working hard, as opposed to shirking, at $5.

Suppose the total revenue gained by the team is divided equally among the team members. Will Jim choose to shirk or work hard?

A. Definitely shirk.

B. Work hard if there are five or fewer team members, but shirk if there are more than five team members.

C. Definitely work hard.
D. Work hard if there are five or more team members, but shirk if there are less than five team members.

My Thoughts: If there are more than 5 people, shirking is more possible...

Obviously, companies cannot make hiring or firing decisions based on political affiliations. But in cases where the company has a strong stake in the election of a candidate or passage/failure of a measure or initiative, can a company deny you a promotion, perk, bonus, or other benefit based on political affiliations.

I mean, are there situations where you have to sacrifice your personal convictions at the altar of company loyalty as far as political matters are concerned. Would you fear being called a "Benedict Arnold" in the company's eyes--because from the firm's perspectice, you are basically engaging in treason, if you take the side opposite that which the firm takes. I mean, does working for the company require you to also support the organization's political goals in addition to its business goals. For instance, can an employee be required to attend a political rally (e.g. a candidate visit or an anti-war protest) or sign a petition?
What I really am talking about was this: Can you be in trouble with your company if you do not support its political causes by voting for the positions and candidates that the company endorses? I mean, isn't there any way that the company can find out how its employees voted without asking them (e.g. checking with the county elections office)?

CAMPAIGN AGAINST BRITISH SUMMER TIME

Ever since I first found out about British Summer Time (BST), I wondered what on Earth the point of it was - I mean, the sun comes up when it comes up, doesn’t it; regardless of what your clock is showing when it happens?
I was about six years old when I figured this out, and yet the government still doesn’t seem to have realized the futility of BST.
And what is the alleged purpose of BST? To allow farmers (0.016% of the population, at last reckoning) to get up ‘earlier’ and work ‘later’ during the summer months, or something. Has it not occurred to these farmers that they should just get up earlier on their own initiative, like everyone else (99.984% of the population) has to? What difference does it make, what time your clock shows?
For a government, whose stated purpose is to do whatever is best for the majority of the population it controls, does it not at least seem a little misguided to do something that only 0.016% of its people benefit from? Beside the fact that this 0.016% don’t actually benefit at all from BST anyway?
Now, some people have put forward the thought that most of the population do in fact benefit from farmers, producing food as they do; and this is a fair point. But would you be concerned if you knew that your potatoes had been harvested at 7.30 in the morning instead of 8.30? I don’t think so.
Add to all of this that most farmers get up at ridiculous times in the morning anyway, and really begin to wonder what the point of it all is.
In addition to all of the above, it should be noted that much of the food we eat is now imported - in other words, grown by farmers in other countries who do not have the ‘benefit’ of BST. Farmers in other parts of the world (roughly 98.65% of farmers) just get up and do their work like everyone else, and don’t request bizarre clock-changes that mess up everyone elses’ biorhythms and don’t actually help them at all anyway.
This growing prevalence of cheaper imported food also raises the question of what farmers in Britain actually do these days. We’ve all known for years that the government pays farmers not to grow some crops, thus regulating the food price index; and even pays many farmers to stockpile food they’ve already harvested (grain mountains, butter mountains and the slightly less imaginable milk mountains spring to mind). Therefore, why are these farmers in such a hurry to get up in the mornings anyway?
Also, it should be brought to your attention that an increasing amount of farming land is being given over to the production of biofuels, which don’t actually benefit anyone (they cause more carbon emissions in production than the equivalent amount of petrol or diesel does during combustion, in addition to the pollution emitted when they themselves are burned). And, in relation to BST, the rapeseed plants (that the oils for these fuels are harvested from) don’t know or care what time of day it is.
All of this still doesn’t explain why farmers see the need to drive their tractors along A-roads during peak traffic times. The suspicion arises that they don’t have anything else to do (being paid by the government not to grow anything) and are a bit bored (having got up really early in the morning and not having done anything since). I know it’s not specifically related to the subject, but tractors are designed to drive across fields, yes? So why do they have to drive on the roads at all? And if the do, why not do it when they get up, ridiculously early in the morning?

Therefore, considering all of the above, what about an initiative to promote GMT 24/7 and force the government to recant the outdated and impotent British Summer Time law?
Initially I propose a campaign of ridicule, starting with always referring to BST as ‘British Stupid Time’. This, I hope, will reinforce to the government the depth of feeling amongst the people with regard to the antiquated and defunct law.
Next, there should be some sort of petition, signed (obviously) by as many people as possible. This will be presented to the Prime Minister (or whoever passes for that at the time) by myself, or someone designated by the members of the Campaign.
Media coverage is of course another obvious tool we can use in our efforts, and pretty much any publicity will be good - be creative and think of some things to do that will raise awareness of our mission.
If the government fails to respond to all of the above, there is the final step of just boycotting BST wholesale. This really is a situation where if we all just ignore BST, it will go away - the government simply cannot ignore 99.984% of the population forever.
So then, let us go forth and cancel this aberration, doing our part to bring normality back to Britain (there is obviously a lot more involved in that than just getting the clocks right; but one step at a time, eh)?
What do you all think??

The California Supreme Court's decision that the law against same sex marriage is unconstitutional takes effect in 30 days allowing same sex couples to marry, but the court's decision could be overturned in November due to initiative petitions that have already been submitted for a state constitutional amendment to ban same sex marriage.

Since same sex marriage wasn't currently legal in the other states that have passed amendments banning it, will there be a backlash against California voters if the ban passes since they will be taking away a civil right for same sex couples that they already have?

TO ALL TRINI'S

Over the past two years, we have been faced with a continuous escalation of food prices, but how much of
it is justified? Some businesses are taking advantage to maximize their profits and I believe one such
company is KFC.

Let's look at a breakdown. A chicken can be divided into 9 parts; 2 legs, 2 thighs, 2 wings, 2 side
breasts and one centre breast. A medium chicken retails at the supermarket for around $35. KFC
literally buys truckloads of chicken daily so we can assume they would pay around $30 for the same size
chicken.. How much does KFC sell the same nine pieces of chicken for? $78! A PROFIT OF $48 PER CHICKEN!

What's worse, a regular size soft drink sells for $5. Pour out the ice and see just how much drink you get
for $5. just about half a cup.

The worst of it all - KFC sells a 400ml bottle of Blue Waters
for $4.50. I made a call to Blue Water and they
said a case of 400ml water sells for $34. that's $1.41 per bottle. KFC buys water by the truckload and would
get it much cheaper. THEY MAKE $3.00 - $3.25 PROFIT ON A SMALL BOTTLE OF WATER!

We work hard for our money and we are getting little value for our hard earned dollars. We all need to
call Prestige Holdings - the parent company of KFC at 623-2646 and tell them that if they do not show
justification for their prices or reduce them... WE NOT BUYING! It's time we make a united stand on
principles of fairness. AS CONSUMERS WE HAVE THE POWER IN OUR OWN HANDS. I urge you to consider this
initiative and please forward this E-mail to everyone in your address book and encourage them to keep passing it along.

Take a stand man..this getting outta hand

5. recall A. allows voters to elect each party's candidate for office
B. allows citizens to vote in private and so avoid being pressured to vote a certain way
C. allows voters to vote an official out of office
D. allows citizens to sign petitions proposing laws to be considered by their states' legislatures
E. allows votersto approve laws or amendments proposed by their states' legislatures

In California, a petition must gather 8% of the number of voters in the last gubernatorial election to become a ballot initiative if it's an amendment to the constitution. If it qualifies, does anyone know what percentage it must pass with the voters to amend the CA constitution? Is it simple majority (>50%) or a 2/3 majority? Thank you.
